Ō27 respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how Broadview Real Estate, together with their respective affiliates and associated entities (collectively, “Developer,” “we,” “us,” or “our”), collect, use, disclose, and protect information in connection with the website located at discoverO27.com and any subdomain, staging environment, microsite, digital brochure, and online service that links to this Privacy Policy (collectively, the “Site”). The Site markets Ō27, a proposed office development at 4701 Westheimer Road, Houston, Texas 77027 (the “Project”).
By accessing or using the Site, you acknowledge that you have been provided this Privacy Policy. This Privacy Policy is a notice of our information practices; it is not intended to obtain consent where applicable law requires a separate, freely given, informed, and unambiguous consent, and it does not create contractual rights beyond those imposed by applicable law. If you do not want us to collect information through the Site as described here, do not use the Site or provide information to us.
1. Scope
This Privacy Policy applies to information collected through the Site and through email, telephone, text, and in-person communications with us or our leasing representatives that reference this Policy. It does not apply to information collected by third-party websites or services linked from the Site, or to information collected offline in connection with a lease negotiation, credit application, guaranty, or executed lease, which is governed by the applicable agreement and our separate business practices.
The Site is a business-to-business marketing website for a commercial office development. The information we collect is primarily business contact and professional information provided by prospective tenants, tenant representatives, brokers, lenders, investors, consultants, vendors, and members of the media acting in a professional capacity. Some privacy laws, including California law when applicable, may protect personal information relating to business contacts even when collected in a commercial context. We do not request or knowingly collect through the Site sensitive personal data such as government identification numbers, financial account credentials, precise geolocation, health information, biometric identifiers used for identification, or information about racial or ethnic origin, religious beliefs, or sexual orientation. Please do not submit sensitive personal information through general Site forms, email, or text unless we specifically request it through an appropriate process.
2. Information We Collect
Notice at Collection. For purposes of applicable U.S. state privacy laws, the categories of personal information we may collect through the Site include identifiers and contact information; professional and employment-related information; commercial and leasing-inquiryinformation; internet or other electronic activity; approximate geolocation derived from IP address; and inferences or lead information derived from those categories. The business and commercial purposes for collection are described in Section 4, the categories of recipients in Section 5, and our retention criteria in Section 6. We do not knowingly use or disclose sensitive personal information for purposes that would require a right to limit under applicable law.
Information you provide directly. When you submit an inquiry form, request information, schedule a tour, register for updates, download materials, or otherwise contact us, we may collect:
- name, title, and company, fund, or brokerage affiliation;
- business email address, telephone and mobile numbers, and mailing address;
- real estate license number and brokerage (for brokers);
- information about your space requirements, including desired square footage, headcount, timing, budget, current lease expiration, current location, and decision-making process;
- the content of your messages, questions, and communications with us, including emails, voicemails, and text messages; and
- any other information you choose to provide.
Information collected automatically. Depending on the technologies enabled on the Site, when you visit we and our service providers may automatically collect information through cookies, pixels, tags, web beacons, log files, session-recording or heat-mapping tools, and similar technologies, including:
- IP address and approximate geographic location derived from it;
- device type, device identifiers, operating system, browser type and version, screen resolution, and language settings;
- referring URL, search terms, pages viewed, links clicked, files downloaded, time spent on pages, scroll depth, mouse movements, and the date and time of each visit;
- interactions with virtual tours, floor-plan viewers, videos, forms, and other interactive features; and
- unique identifiers assigned by cookies, analytics tools, or advertising platforms
Information from third parties. We may receive information about you from brokers who submit inquiries on your behalf; from any leasing agent we engage; from our public relations, marketing, and advertising partners; from business-data and lead-enrichment providers; from social media platforms when you interact with our content there; and from public sources, including LinkedIn, company websites, state licensing databases, and commercial real estate databases, in order to verify, supplement, or update your contact and company information. We may combine information from these sources with information you provide and information collected automatically.
3. Cookies and Tracking Technologies
The Site may use cookies, pixels, tags, web beacons, session-recording or heat-mapping tools, and similar technologies, some placed by us and some by third-party hosting, security, analytics, advertising, form-processing, or content providers. The particular tools enabled may change as our Site and vendors change. Strictly necessary technologies may operate automatically where permitted by law. Non-essential analytics or advertising technologies will be used subject to the consent, notice, or opt-out requirements that apply in the relevant jurisdiction. A cookie banner or preference tool displayed on the Site, if any, is intended to allow you to make choices for that browser or device.
These technologies are used for the following general purposes:
Strictly necessary - Operating the Site, security, form submission, load balancing, bot detection, and fraud prevention
Analytics and performance - Measuring traffic, understanding how visitors navigate and engage with the Site, recording sessions, and diagnosing errors
Marketing and advertising - Measuring campaign performance, attributing inquiries to their source, tracking conversions, building audiences, and delivering interest-based advertising for the Project on third-party websites, apps, and platforms
Functional - Remembering preferences and enabling embedded third-party content such as maps, videos, scheduling tools, and virtual tours
You can control cookies through your browser settings, which typically allow you to refuse or delete cookies; disabling cookies may impair Site functionality. Where required by law, we will request consent before placing non-essential cookies and will honor applicable opt-out preference signals, including Global Privacy Control (GPC), as required. Industry opt-outs for interest-based advertising and individual provider opt-out tools may also be available. Opting out does not necessarily stop all advertising; it generally limits certain interest-based advertising or data transfers associated with it.
4. How We Use Information
We use the information we collect, alone or in combination, to:
- respond to your inquiries, schedule and conduct tours, and provide information about the Project, availability, and pricing;
- market and lease space in the Project and related or future developments, including by contacting you by email, telephone, text message (where you have opted in), and mail;
- evaluate prospective tenants and verify the identity, employer, authority, license status, and brokerage affiliation of persons making inquiries;
- maintain our customer relationship management (CRM), prospect, and leasing-pipeline records and share them with our leasing team and advisors;
- operate, maintain, secure, analyze, and improve the Site, our marketing programs, and our understanding of prospect behavior;
- measure the effectiveness of advertising and deliver interest-based advertising on third-party platforms;
- comply with legal, regulatory, tax, and reporting obligations; enforce our Terms of Use; protect the rights, property, and safety of the Project Parties (as defined in the Terms of Use) and others; and detect and prevent fraud, abuse, and security incidents;
- support any financing, sale, recapitalization, joint venture, or other transaction involving the Project or Developer, including due diligence; and
- for any other purpose disclosed to you at the time of collection or with your consent.
We may aggregate, pseudonymize, or de-identify information so that it no longer reasonably identifies you and use and disclose such information for lawful purposes. Where applicable law treats de-identified data specially, we will take reasonable measures to maintain it in de-identified form and will not attempt to re-identify it except as permitted by law. We do not use personal information collected through the Site to make decisions producing legal or similarly significant effects through solely automated processing
5. How We Share Information
We may disclose information we collect as follows:
- Affiliates and Project Parties. With our parents, subsidiaries, affiliates, associated entities, sponsors, general partners, and co-developers, and with the Project Parties named in the Terms of Use, including STG Design (architect), Design ALT + TAB (grand entrance design), and Public Content (public relations), where relevant to a space inquiry, design or build-out discussion, media request, or marketing activity.
- Leasing agents and brokers. With any leasing agent or licensed brokers Developer may engage to market the Project, and with the tenant-representative broker, if any, you identify.
- Service providers and processors. With vendors that process personal information on our behalf for functions such as website hosting, form processing, CRM, email or text delivery, analytics, security, virtual tours, video hosting, scheduling, data enrichment, IT, and professional services. Where required, our contracts restrict their processing and require appropriate confidentiality and security obligations.
- Advertising and analytics partners. Certain advertising, analytics, social-media, or similar partners may receive device, cookie, interaction, or conversion information and may process that information under their own terms or as independent third parties. Depending on the technology and applicable law, these disclosures may constitute a “sale,” “sharing,” or processing for “targeted advertising.”
- Lenders, investors, and transaction parties. With actual or prospective lenders, equity partners, investors, purchasers, insurers, and their advisors in connection with the financing, sale, recapitalization, merger, joint venture, or other transfer of all or part of the Project or Developer, including during due diligence, and with successor owners or operators of the Project.
- Project consultants. With architects, engineers, contractors, property managers, and other consultants where relevant to a space inquiry or build-out discussion.
- Legal, safety, and enforcement. When we believe disclosure is required by law, subpoena, court order, or governmental request, or is appropriate to protect the rights, property, or safety of any Project Party, our tenants, our users, or others, to enforce our Terms of Use, or to investigate fraud or security incidents.
- With your consent or at your direction.
We do not sell personal information for monetary consideration. However, as noted above, use of certain third-party advertising, analytics, or social-media technologies may constitute a “sale,” “sharing,” or processing for “targeted advertising” under some state privacy laws even when no money changes hands. Where those laws apply, you may exercise the applicable opt-out rights described in Section 8. We do not knowingly sell or share sensitive personal information through the Site.
6. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy and consistent with applicable law. Retention depends on the category and context: prospect, inquiry, CRM, and leasing records may be retained throughout active evaluation, Project marketing, lease-up, stabilization, and a reasonable period afterward; marketing-preference and suppression records may be retained as needed to honor opt-outs; technical, analytics, and cookie data are retained according to our configuration and the applicable provider’s settings; and legal, tax, insurance, security, and dispute-related records may be retained for applicable limitation periods or longer where required by law, litigation hold, or regulatory inquiry. Aggregated or de-identified information may be retained longer or indefinitely where legally permitted. Backup copies may persist for a limited period until overwritten in the ordinary course.
7. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. However, no internet transmission, email system, or method of electronic storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive or confidential information through general Site forms or ordinary email unless requested through an appropriate process. If you have reason to believe your interaction with us is no longer secure, notify us promptly at experience@discovero27.com. Any limitations of liability relating to the Site are governed by the Terms of Use only to the extent permitted by applicable law.
8. Your Privacy Rights and Choices
Marketing communications. You may opt out of marketing emails at any time by using the unsubscribe mechanism in the message or by contacting us at experience@discovero27.com. You may opt out of text messages by replying STOP where supported or by using another reasonable revocation method communicated to you. We may continue to send non-marketing, transactional, or relationship communications relating to a pending inquiry, scheduled tour, security issue, or lease negotiation where permitted by law.
U.S. state privacy rights. Depending on where you reside, the law applicable to Developer, and the nature of the information, you may have rights to confirm processing; access, correct, or delete personal information; obtain a portable copy; opt out of targeted advertising, sale, or certain forms of profiling; limit certain uses or disclosures of sensitive personal information; appeal a denial; and receive equal service without unlawful discrimination for exercising privacy rights. California residents may have these rights, when the California Consumer Privacy Act applies to Developer and the information, including with respect to personal information collected in a business-to-business context. Rights and exceptions vary by state and are subject to applicable thresholds, definitions, exemptions, verification requirements, and legal exceptions.
Texas residents. The Texas Data Privacy and Security Act applies to Texas residents acting in an individual or household context and generally excludes individuals acting in a commercial or employment context. To the extent the TDPSA applies to your information and to Developer, you may exercise the rights provided by that law by contacting us as described in Section 15. We will respond within the period required by law, subject to any permitted extension. If we deny a request, you may appeal by replying to our response with “Appeal.” If an appeal is denied, we will provide information about how to contact the Texas Attorney General where required.
Opt-out of targeted advertising and “sale” or “sharing.” Where applicable law gives you an opt-out right, you may use any cookie-preference or privacy-control link offered on the Site, enable a recognized opt-out preference signal such as GPC in your browser, or contact us at experience@discovero27.com. We will honor browser-based opt-out preference signals where legally required and technically recognized. If applicable law requires a dedicated “Do Not Sell or Share My Personal Information” or similar mechanism, the Site will provide one.
Verification, authorized agents, and appeals. To protect personal information, we may take reasonable steps to verify your identity, authority, or residency before completing a request. An authorized agent may submit a request where applicable law permits, subject to proof of authorization and any permitted direct verification. We may deny or limit requests where an exemption applies, where identity or authority cannot reasonably be verified, or where a request is manifestly unfounded, excessive, repetitive, or otherwise subject to lawful denial. We will provide appeal instructions where applicable law requires them. Privacy requests may be submitted by email to experience@discovero27.com or by mail to the address in Section 15.
9. Do Not Track
Some browsers offer a “Do Not Track” (DNT) signal. Because there is no industry standard for DNT, the Site does not currently respond to DNT signals. We honor GPC signals as described above where required by law.
10. Children’s Privacy
The Site is a commercial real estate marketing website intended for business users aged 18 and older and is not directed to children. We do not knowingly collect personal information online from children under 13, and we do not knowingly sell or share for targeted advertising the personal information of individuals under 16. If we learn that we collected personal information from a child in circumstances requiring deletion or parental authorization, we will take appropriate steps under applicable law. A parent or guardian who believes a child has provided us information may contact us at experience@discovero27.com.
11. Third-Party Websites and Services
The Site may link to or embed content from third-party services, including social media platforms, mapping services, video hosts, virtual tour providers, scheduling tools, and advertising networks. These services may collect information about you through their own cookies and technologies, governed by their own privacy policies, over which we have no control. No Project Party is responsible for the privacy practices of any third party. We encourage you to review the privacy policies of any third-party service you access.
12. International Visitors
The Site is operated from the United States and is directed to persons evaluating office space or the Project in Houston, Texas. If you access the Site from outside the United States, your information may be transferred to, stored, and processed in the United States and other locations where our service providers operate. Privacy protections in those locations may differ from those in your jurisdiction. The Site is not intentionally directed to residents of the European Economic Area, United Kingdom, or Switzerland. If privacy or data-transfer laws outside the United States nevertheless apply to a particular processing activity, we will address the applicable legal basis and transfer requirements as required by law rather than relying solely on your general use of the Site as consent.
13. Business Transfers
If Developer or the Project is involved in a financing, sale, recapitalization, merger, acquisition, joint venture, reorganization, bankruptcy, receivership, or transfer of all or a portion of its assets, personal information may be transferred to the acquiring, successor, or financing party and its advisors as part of that transaction, including during due diligence, subject to the commitments in this Privacy Policy or as otherwise permitted by law.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be posted on the Site with a revised Effective Date and will apply from that date unless applicable law requires additional notice, consent, or a different effective date. Where required by law, we will provide additional notice of material changes or obtain any required consent. We encourage you to review this Privacy Policy periodically.
